We can not forget that, because of regulations regarding the separation of properties, these women are in a defenceless situation if they lack their own property, having to depend in most cases on their husbands’ testament. L’esclusione delle donne dalla successione legittima è il principio che struttura l’intero sistema patrimoniale di età medievale e moderna e ha riflessi decisivi sull’organizzazione sociale e sull’articolazione dei poteri pubblici fino al XIX secolo, perlomeno in Italia. Però, nonostante questa centralità, l’esclusione delle donne dalla successione legittima è stata oggetto di una distorsione prospettica che, almeno nella storiografia italiana, l’ha oscurata privilegiando analisi centrate sul sistema dotale e accordandole spazio negli studi giuridici sulla devoluzione dei beni senza però un focus specifico.
